1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the website and services provided by Local Surge Pro ("we," "us," or "our"), a digital marketing and AI automation service operating in Georgia. By accessing our website, using our services, or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Services Provided
Local Surge Pro provides the following services to home service businesses:
AI-powered phone receptionist systems
AI chat widget lead capture and booking automation
Website design and development
Google Business Profile optimization
AEO (Answer Engine Optimization) website optimization
SMS and email automation workflows
Lead follow-up and review request automation
The specific services provided to each client are outlined at the time of engagement. We reserve the right to modify, update, or discontinue any service with reasonable notice.
4. Payment and Billing
Our base service fee is $97 per month, billed automatically via Stripe on a recurring monthly basis.
Additional AI usage fees (voice minutes and messages) are billed based on actual usage above the included allowance at rates disclosed at the time of enrollment.
All fees are billed in US dollars.
You authorize us to charge your payment method on file for all applicable fees.
Failed payments may result in suspension of services until the outstanding balance is resolved.
5. Cancellation
There is no long-term contract. You may cancel your service at any time by contacting us at [email protected] or +1 470-536-8177. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months of service already paid.
6. Client Responsibilities
As a client, you agree to:
Provide accurate and complete business information required to set up and operate your AI system
Ensure your use of our services complies with all applicable laws, including TCPA regulations governing SMS communications
Obtain any necessary consents from your own customers before those customers are contacted by AI systems we set up on your behalf
Not use our services for any unlawful, deceptive, or abusive purpose
Keep your login credentials and account information secure
7. SMS Compliance
Our services include SMS messaging functionality. By using our SMS features, you agree to comply with all applicable laws and regulations including the Telephone Consumer Protection Act (TCPA) and carrier guidelines. You are responsible for ensuring that all contacts in your system have provided proper consent to receive SMS messages. Local Surge Pro is not liable for any TCPA violations resulting from your use of our messaging services.
8. Intellectual Property
All content, designs, code, and materials produced by Local Surge Pro for your business become your property upon full payment for those services. Local Surge Pro retains ownership of its proprietary systems, templates, workflows, and underlying technology used to deliver services. We grant you a non-exclusive license to use those systems solely in connection with your business during the term of your subscription.
9. Results Disclaimer
We make no guarantee of specific results, including but not limited to the number of leads generated, appointments booked, or revenue earned from our services. Results vary depending on your business, market, call volume, and other factors outside our control. Any revenue projections or estimates shared in our marketing materials are illustrative examples only and not guarantees of performance.
10. Limitation of Liability
To the fullest extent permitted by law, Local Surge Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data, arising from your use of our services. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount you paid us in the three months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Local Surge Pro, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.
12. Third-Party Services
Our services integrate with third-party platforms including GoHighLevel, Twilio, Google, and Stripe. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
13. Termination
We reserve the right to suspend or terminate your access to our services at any time if you violate these Terms, fail to pay applicable fees, or engage in conduct that we determine, in our sole discretion, to be harmful to our business or other clients. Upon termination, your right to use our services ends immediately.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Georgia.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
